Terms of Service
Effective 1 October 2026. Covers dviilo — the platform, this website and the dviilo Android app.
These terms are an agreement between you and Shivankit TechSolutions (OPC) Private Limited (“Shivankit TechSolutions”, “we”). Using dviilo means you accept them. If you don't, don't use it.
1. This is a beta
dviilo is in beta. Things will break and features will change. Do not put it in the path of anything where a failed or wrong call causes real harm — medical, legal, financial or safety-critical situations included.
Beta access is free, subject to fair use. We may change or end beta access.
2. Your account
- You must be 18 or older.
- Give accurate information, and keep your sign-in to yourself. Anything done through your account is your responsibility.
- Don't resell access, or share it with people whose actions you can't answer for.
- Tell us at hello@shivankit.com if you think your account has been compromised.
3. What you may not do with it
dviilo places and answers real calls and sends real messages, so misuse can put our telephony and messaging providers in breach of their own obligations. You may not use it to:
- Make unsolicited bulk or automated marketing calls or messages, or anything that breaches TRAI regulations, the Do Not Disturb registry, or equivalent rules where you operate.
- Impersonate another person or organisation; hide from the people your assistant speaks with that the conversation is recorded and handled by an AI assistant; or have it deny being an AI when asked.
- Defraud, phish, harass or threaten anyone, or extract credentials, OTPs or payment details from them.
- Record anyone where that is unlawful where they are, or without the consent your sector requires.
- Probe or overload the service, reverse-engineer it, or get around its limits.
- Break any applicable law.
We may suspend an account when we have good reason to think this section is being broken.
4. Your responsibilities for the people your assistant speaks with
When your assistant speaks with someone, your organisation is the Data Fiduciary for that conversation. Telling them that it is recorded, handled by an AI assistant and may be used to improve the service — and any consent or sector-specific obligation that goes with it — is your organisation's responsibility. We do not judge whether a particular use is lawful in its context.
5. Content and ownership
- Yours stays yours. Your recordings, transcripts, contacts, instructions and voices belong to you. We use them to run the service for you and, as set out below, to improve our models.
- Ours stays ours. The service, the app and what we built to make them work remain ours. You get a limited, non-exclusive, non-transferable right to use the service.
- Voices.Create a voice only from your own, or from one you have explicit written permission to use. Creating anyone else's is grounds for immediate termination and is your liability.
- Model improvement.Unless your organisation turns it off, you give us permission to use your organisation's calls and conversations, past and future, to train, evaluate and improve our models: the audio and the transcript matched to it, for speech recognition; and the text, including which tools your assistant used and what they returned, for our language models. This includes conversations with other people, for which your organisation is responsible as section 4 describes. The setting is held by the organisation; an owner turns it off by writing to hello@shivankit.com, and conversations after that are not used. This permission does not transfer ownership of anything, and it does not cover voices you create. The Privacy Policy describes what is used and how.
6. The Android app
The app is licensed, not sold, and needs a dviiloaccount. It registers with Android's calling system so your assistant's calls behave like calls, and asks for the permissions described in the Privacy Policy. The copy from Google Play updates only through Google Play.
7. Third-party services
dviilo depends on carriers, speech and language providers and cloud infrastructure, described in the Privacy Policy, and on any service you connect to your assistant. Their outages become ours, and we don't control their networks.
8. Availability
There is no uptime guarantee. We do not promise the service will be uninterrupted, that transcription will be accurate, or that your assistant will always say or do the right thing. AI models get things wrong; check anything that matters.
9. Liability
To the maximum extent Indian law allows, the service is provided “as is” and we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We are not liable for indirect, incidental, special or consequential damages, or for lost profits, business or data. Our total liability for any claim is capped at the greater of what you paid us in the twelve months before the claim, or ₹5,000.
Nothing here excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence.
10. Indemnity
If someone brings a claim against us because of how you used dviilo— a call you had it make, a notice you didn't give, a consent you didn't obtain, a voice you shouldn't have created — you agree to cover the resulting costs and damages.
11. Ending it
You can stop whenever you like, and delete your account. We may suspend or end an account for a breach of these terms, for a legal reason, or if we discontinue the service. When an account ends, the right to use the service ends with it, and data is kept or deleted as the Privacy Policy describes.
12. Changes to these terms
These terms can change. The version in force is the one at this address, with its effective date at the top, and it applies from that date. Every earlier version stays readable at its own dated link. Continuing to use dviilo means you accept the version in force.
13. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
